1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of our website, communication channels (including SMS), and the services provided by Firewater LLC ("Company," "we," "us," "our"). By accessing our website, requesting a quote, booking service, or communicating with us, you agree to these Terms and our Privacy Policy.

All clients are directed to review these terms and conditions in print on quotes. If you do not agree, do not use our website or services.

2. Services & Estimates

A. Service Scope

We provide exterior cleaning services, which may include pressure washing, soft washing, surface cleaning, and related cleaning services ("Services"). The exact scope depends on the quote, job notes, and the conditions on-site.

B. Quotes & Pricing

  • Quotes may be provided by phone, text, email, online forms, or in person.
  • Unless stated otherwise, quotes are based on visible conditions at the time of quoting and the information you provide.
  • If we discover additional conditions (e.g., severe staining, access issues, special safety needs, heavy buildup, pre-existing damage, water restrictions), we may revise the scope and price before proceeding.

C. Scheduling

Appointment dates and times are estimates and may change due to weather, equipment issues, staffing, safety concerns, or other delays. We will make reasonable efforts to notify you of changes.

3. Customer Responsibilities

To help us complete the job safely and efficiently, you agree to:

  • Provide accurate contact and property information.
  • Ensure reasonable access to the work areas (gates unlocked, pets secured, vehicles moved if needed).
  • Ensure water access (and electricity access when required) unless otherwise agreed.
  • Notify us in advance about fragile surfaces, known issues, prior repairs, loose materials, specialty coatings, or areas of concern.
  • Follow any pre-service instructions we provide (e.g., closing windows, moving outdoor items).

4. Weather, Safety, and Right to Refuse Service

For safety and quality, we may reschedule or pause work due to rain, wind, freezing temperatures, lightning, extreme heat, unsafe site conditions, or other hazards.

We reserve the right to refuse or stop service if:

  • A site is unsafe or inaccessible,
  • There is harassment, threatening behavior, or unsafe animals,
  • There is undisclosed damage or hazardous conditions,
  • Payment terms are not met.

5. Payments, Deposits, and Fees

A. Payment Terms

Unless otherwise agreed in writing:

  • Payment is due upon completion of services (or upon invoice issuance, if invoiced).
  • We accept payment methods as communicated at the time of booking/invoicing.

B. Deposits

Some jobs may require a deposit to reserve a date. Deposit requirements will be communicated in advance.

C. Late Payments

Unpaid balances may be subject to late fees and/or collection costs as allowed by law.

D. Cancellations / No-Shows

We understand schedules change. If you need to cancel or reschedule, please provide as much notice as possible. We may charge a reasonable trip fee for last-minute cancellations or no-shows, when permitted by law and communicated before scheduling.

6. Results, Surface Conditions, and Limitations

A. No Guarantee of Complete Stain Removal

Stain treatment products may not be used in some instances (i.e. Specials) but are included in regular pricing. Clients wanting stain treatment products applied should select regular services. Cleaning improves appearance, but we do not guarantee complete removal of all stains. Some discoloration may be permanent (e.g., rust, oxidation, etched surfaces, paint failure, deep organic staining, tannins, mineral deposits, or prior chemical damage).

Upon completion of service, the client agrees to inspect the work within 72 hours (24 hours on fleet). Unsatisfactory areas must be addressed during this period. Any concerns, missed areas, or requests for touch-ups must be reported within this 72-hour window. After 72 hours, all services are considered complete and satisfactory. Any additional cleaning, corrections, or re-washing requested after the 3-day period will be treated as a separate job and will require a new quote.

B. Pre-Existing Damage

We are not responsible for damage caused by pre-existing conditions, including but not limited to:

  • Loose paint, failing sealants, deteriorated wood, cracked siding, loose mortar, damaged stucco/EIFS, brittle vinyl, compromised caulk, or aged surfaces.
  • Water intrusion due to pre-existing gaps, failing window seals, or improper installation.

C. Landscaping & Exterior Items

We take reasonable care around landscaping and fixtures. You are responsible for removing or securing delicate items. Please note that Firewater does not move items left in work area. Any items in the area to be cleaned will need to be removed by the client prior to job start. Items that cannot be moved should be covered with plastic. Firewater is not responsible for items left in the cleaning area.

Firewater employees will make every effort to prevent damage to surfaces involved in cleaning (onsite evaluation, prewatering of landscape). The client understands that while every reasonable effort will be made to prevent damage, there may be outlying factors related but not limited to initial structure, damage, upkeep, maintenance, etc. of the area resulting in unforeseen damage. Firewater does not assume liability of such incidents but is the client's responsibility to be knowledgeable of the surface and surrounding area to be cleaned. Some temporary disturbance (e.g., debris movement, water runoff) may occur.

7. Photos and Marketing

We may take before/after photos or videos of property to be cleaned.

These photos are the property of Firewater LLC and may be used for work documentation, quality control, training, or marketing purposes (website, social media, ads). If you prefer we do not use images of your property, tell us in writing before service.

8. SMS Messaging Terms & Compliance

8.1 Program Description

Our SMS program sends appointment confirmations, reminders, rescheduling updates, and customer support communications via our forms or other software-based methods. Email may also be used.

8.2 Cancellation Instructions

You can request to cancel SMS messages or emails at any time by sending request to info@firewatercorp.com. Every reasonable attempt will be made to remove you from these services, understanding that you may inadvertently receive future communication from time to time as systems are updated.

8.4 Carrier Liability

Carriers are not responsible for delayed or undelivered messages.

8.5 Message & Data Rates

Message and data rates may apply. Message frequency varies based on your service activity and appointment schedule. Contact your wireless provider for plan details and if your carrier supports these services.

8.7 Age Restriction

You must be 18 years or older to participate.

8.8 Privacy

We do not share or sell client information with any other entity. Every reasonable effort is made to protect client data, including firewall securities and encryption services.

We aim to comply with applicable laws and guidelines regarding client data.

9. Intellectual Property

All content of our website (text, images, logos, graphics, and design) belongs to Firewater LLC or its creators and is protected by intellectual property laws. You may view and print pages for personal, non-commercial use only. You may not copy, reuse, or distribute site content without the written permission of Firewater LLC.

10. Third-Party Links

Our website may contain links to third-party sites. We do not control those sites and are not responsible for their content, services, or privacy practices.

11. Disclaimers

Our website and services are provided on an "as-is" and "as-available" basis to the fullest extent permitted by law. We do not make guarantees about uninterrupted website access, error-free content, or outcomes beyond the agreed scope.

12. Limitation of Liability

To the fullest extent permitted by law, Firewater LLC will not be liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim related to services provided will not exceed the amount paid to us for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Firewater LLC, its owners, and employees from claims, damages, liabilities, costs, and expenses arising from:

  • Your misuse of the website,
  • Your breach of these Terms,
  • Unsafe conditions you fail to disclose,
  • Your violation of any law or third-party rights.

14. Termination of Website Access

We may suspend or terminate access to our website or communications if we believe there is misuse, unlawful conduct, or violations of these Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law rules.

Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in South Carolina, unless otherwise required by law.

16. Changes to These Terms

We may update these Terms from time to time. Updates will be identified by a website notification upon logging on, lasting 30 days from the date updates are made. Continued use of our website or services after updates constitutes acceptance of the revised Terms.
